Agency Membership & Certification

The standard mark for recruitment agencies — earned, not bought.

Since April 2026, one regulator sees your whole business. The Fair Work Agency has replaced the three bodies agencies used to deal with separately, and the Employment Rights Act is rewriting the rules through 2027 — doubled tribunal time limits from October, six-month unfair dismissal rights from January, guaranteed-hours rules for agency workers on the way. Your clients know it. They are already choosing suppliers who can prove they’re on top of it.

BIOR Certification is that proof.

Certification you have to earn

BIOR Certified agencies pass the BIOR Certification Assessment — a compliance assessment created with input from the UK’s employment-rights enforcement bodies, whose functions now sit within the Fair Work Agency, and kept current as the law changes. You provide a client reference and a candidate reference, commit to the Code of Professional & Ethical Conduct (which includes an express duty to co-operate with the FWA), and re-assess every five years.

That’s why the BIOR Certified logo means something on a tender: it can’t be bought. It certifies that your agency’s processes were tested against current UK recruitment law.

What you can show for it: the BIOR Certified Agency logo and certificate for your website, proposals and tenders — and free individual certification for your recruiters, with post-nominals they can carry.

The Agency Compliance Pack — the documents behind the standard

Membership includes the document set that lets you evidence compliance quickly when a client — or the FWA — asks:

  • Terms of engagement templates (work-seekers and temps) aligned to the Conduct Regulations
  • Key Information Document template with umbrella pay illustrations
  • Payroll chain due-diligence log — the evidence trail for the umbrella liability rules in force since April 2026
  • Client terms clauses for the new third-party harassment duty (in force 30 October 2026)
  • The 12-point FWA readiness audit in working form, with an evidence checklist per point

Every document is reviewed weekly against government sources and reissued when the law moves — so the pack you hold is never out of date.
